In Nov 2006, after resigning as leader of National in opposition, Brash resigned from Parliament as Key, declined to offer him any position – they would not even let Brash sweep the floors – such is the regard he is held by the present version of the Parlimentary National Party.

Hagar is in part responsible for Key rising.

Bollard, to be taken seriously, has to first lose a safe National seat in an electoral race to Social Credit, have a stint as leader of the opposition, Mount a successful take over of Act whilst being a card carrying member of the National Party, then and only then will Bollard be ready to be the minister of SOEs.

Dr Brash has a Phd in economics and an honorary doctorate in gynaecology – it is this later qualification which best suits his present role as leader of Act.

Bollard holds a post graudate Diploma in parking barricades and has his feet set in concrete.

Brash must be the only one in the big house who has lost to Social Credit - quite an achievement..

I really don't undestand an Act strategic voter at all .

At the last election an Act strategic voter was wanting to ensure that National got and Act as a coalition partner was the guarantee.

This time around the Act strategic voter wants a massie shift to the right.

By way of concession are we likely to see John Banks as the minister of local govt and Don Brash as minister of SOEs.

With the rural party vote in part shifting to Act.

  • Hard News: Angry and thrilled about Arie,

From the Police statement on Scoop.

Inspector Erasmus says under the Police Adult Diversion Policy the defendant had the right to have the decision reviewed. This was done at a district level and later confirmed by Police Prosecution Service, at National Headquarters and the decision stands.

If the decision not to grant a diversion is coming from National headquarters - then local Police have referred it up the chain and don't have much of say – I won’t comment further on the local police behaviour, which speaks for itself.

The insane hard line might well be a Ministerial directive – it could be a blanket directive – no diversion for burglary during this time.

So we can be glad we live in a democracy with an independent judiciary and await a sensible decision to put it to bed.

I can see that the Police might like a guideline set by the Courts - however - the Police behaviour towards TVNZ and the Ppty owners hasn't supported that stance.

There is a problem, perhaps, with the Guys "compulsion” being that it took a hold of him when he was least likely to be caught - and he lucked out.

Other than that the effect of getting convicted would be out of proportion to the nature of the offending.

The Judiciary will make the right decision.

Here is the link to what the offence is and the max jail term:

    Multi choice question.

What are the most likely outcomes of a guilty plea or being found guilty from the list below.

A - Discharge without conviction – a release, no conviction and no criminal record. Used for minor offence and where the effect of getting convicted would be out of proportion to the nature of the offending – May have to pay costs and reparation.

B - Conviction and discharge–convicted with a criminal record but no fine - and you get a criminal record, no penalty. May have to pay costs and reparation.

C - Deferred sentence – An order to come up for sentence if called upon – No sentence the court can make an order that calls you back at any time during a set period (up to one year). You go back to court if you commit another offence during that period or if, you’ve been ordered to compensate the victim and don't. Where you are called back you are sentenced for the original offence and the subsequent offending.

D - Reparation– Pay money to the victim as compensation for emotional harm or property damage. Probation Officers will prepare a reparation report for the judge to consider.

E - Supervision–you’ll be allowed to stay in the community under the supervision of a Probation Officer. The sentence can be for between six months and two years.

F - Community work– an order to do up to 400 hours community work under supervision. A Probation Officer can approve a reduction by 10 % if you have a good attednace record.

G - Imprisonment– Up to the maximum sentence set by the Act creating the offence. The term of imprisonment depends on the severity of the offence, level of involvement, you involvement in the crime, your previous offences and how you’ve behaved under any
    previous sentences.

    I think it will be A, B or C.

But, did TVNZ cross a line in interviewing basically all the participants but the police in a pending trial?

I don't think so - I don’t watch TV as a rule; however, the stream of the Sunday “Tale of two light bulbs” is a great public interest piece.

The court has made recommendations on three occasions the matter be handled by a diversion; this is a pretty good indicator of where it will end up. The judge is attempting to give the Police a face saving out which they do not have the wit to accept.

I have confidence in the NZ Judiciary.

The manner with which the Police have handled this incident is unsettling and unfortunate for everyone involved; including the reputation of the Police.

This is a Police PR exercise going terribly wrong – I find myself asking; couldn’t they catch a real looter and why did the Police chose this man to be paraded in the full media spotlight as the face of looting - this parade oversteps the line IMHO.

The Police have an inherently hard job to do and they need to do it better than this.

Another tangent is, I am glad the police don’t carry side arms as they could have shot this guy.

The public interest apsects are wide ranging and layered and go well outside the nature of the offence.

TVNZ were right to run this peice as they have.

  • Hard News: A Capital Idea?,

I think Dr Brash, after you set his feet in concrete, would make a fine Bollard.

Brash could be chained to Goff, the upper Labour echelon and the Act party carcas.

It could be called the Bollard coalition - A bunch of weak minded individuals past their best arranged in a line to obstruct progress.
