  • Hard News: Media3: Where harm might fall, in reply to Russell Brown,

Extremely unlikely. The LawComm does at least emphasise that political speech requires a high degree of protection.

The irony for me being that politicians can stand up in the House and make allegations that would be actionably defamatory in any other forum, and for which the defamed party has precisely zero recourse for redress. Just saying…

The US is not an example to follow, at all.

Especially when we're talking about jurisdictions where public urination can land you on a public sex offenders register, with all the consequences that flow from that.

It isn’t legitimately public information*. It’s the private information of the community of students that form the school.

Do you think medical records should all be shoved up on an open website, so we can analyse how doctors and patients are doing, with pretty graphics and that?

False equivalence being totally fake. I'll put it this way: I've done several stretches in public hospital psych wards, and I assume there's a file attached to each of them but yeah... I think it's kind of important that data is available to assess whether mental health services are being delivered effectively. There's also plenty of evidence that public transparency is a pretty great tool for exposing systemic failures or abuses. All without "shoving up patient records on an open website.

But so is our education system and the publishing of league tables is, based on all the evidence from around the world, going to do tremendous lasting harm to the education of the children of New Zealand.

Make that argument to your heart’s content, but the Office of the Ombudsman did its job. There is a very good reason why the OIA & LGOIMA don’t include “I don’t like what I think you’ll do with that information” among the grounds for non-disclosure.

My beef is more with Fairfax. I wouldn’t expect to change their minds on publishing this shitty data, but the more we can hold their feet to the fire, the greater the incentive for them to think really bloody hard about what they’re doing. And the consequences of that.

And whether I agreed with you or not, I’d heartily endorse you doing that. What makes me twitchy is those who appear to be encouraging schools to break the law – a law, incidentally, that can be a pretty powerful tool for empowering communities and individuals being stonewalled by school boards, public hospitals and local government.

  • Hard News: Living with the psychopath, in reply to Joe Wylie,

I can only hope the learned judge knows what he’s doing.

Well, I'm certain she's considered all the evidence -- and possibly a lot that's either not in the public domain or not deemed worthy of publication by sensation-junkie media.

I think you might be missing the point that sometimes legitimate and valuable civil protest will break existing laws.

Fine, Bart. I suspect you just don't care how dangerous it is to applaud people who say, in effect "I don't approve of how you might use the information, so go suck eggs" as a justification for flouting the Official Information Act. I'm sure there are plenty of politicians and wannabe Sir Humphrey Applebys who would heartily concur.

I would suggest the following steps for school boards:

I’d suggest they just obey the law. If it's good enough for the Education Ministry, Hekia Parata and her staff...

Meanwhile, Eric Young is an unprofessional dick.

Yup - and this from Sky's head of corporate communications Kirsty Way wasn't exactly gold-worthy PR.

"It was disappointing to see that language used in a tweet and it certainly is against Sky Television's policies to use language like that,"
    [...}
"Although I think Eric's followers may have seen the humour in it and many people may have seen the humour in it, especially when it's read in context with all of his tweets."

I think if anyone talked to Ms. Way like that in the workplace, she would neither see the humour nor be willing to put it in a larger context. Still, nice way to send mixed signals Kirsty!

I really wish people who disagree with Dawkins didn’t feel the need to call him names. You disagree with him, fine, leave the personal abuse out.

Personally, I'd like folks like Professor Dawkins and the late Christopher Hitchens to stop characterizing religious faith as a mental illness -- which is great for your media profile and book sales, I'm sure, but rather unedifying.

  • Legal Beagle: MMP Review: Trusting Voters, in reply to Sacha,

Only if you’re thinking in FPP terms. There are more parties than two.

Perfectly well aware of that. I was trying not to over-qualify my point into a run on sentence that would give Proust the yips. :)

As far as I'm aware Labour is the only party currently in Parliament going through a major constitutional overhaul -- including its candidate selection and list-formation processes. Still damn sure that my input into that would be disregarded on the quite reasonable grounds that I'm not actually a member. Fair enough, too.
