Decision
[112] The appeal is dismissed and the declarations made by Clifford J are upheld in this Court, though for different reasons:
(a) The song is not an election advertisement for the purposes of s 3A of the Electoral Act.
(b) The video is not an election advertisement for the purposes of s3A of the Electoral Act.
(c) The song is not an election programme for the purposes of s 70 of the Broadcasting Act.
(d) The video is not an election programme for the purposes of s 70 of the Broadcasting Act.I haven't seen it reported anywhere except Facebook and NZCity, an election in another country is taking media precedence these days.

Scott Foval, the Dem contractor named, has in fact resigned
I can't find that on any 'reputable' web site. So far all I have found comes from James O'Keefe himself. There is a comment that Fox News reported it but there is nothing about it on their web site.

The Herald has foolishly posted a story that seems to be sourced from fake news site ABCNEWS.com.co The clue being the .co after .com

A very brief bit of Google work found this out so it’s not that the writer, or the Herald, couldn’t fact check this story.
