Can I point out once again that Micael Lhaws* holds an MA in creative writing from Victoria and that at the time when I came across him he had just published the very worthy book of poetry of a dear friend?
This supports the theory that "Michael Laws" is in fact some kind of performance art project.

I swear that marker pens always used to be called Vivids, and didn't start to be called Sharpies until Sharpie started their television campaign.
Here? I obviously don't watch enough TV. I've only every seen 'Sharpie' in US-origin things. I didn't even recognise the brand name.

Incidentally, I think there may have been issues above between 'offence' as in legal-definition-of-a-crime and 'offence' as in an particular illegal incident.

I would assume the official idea is that illegality of a particular act is defined by the law (hence the name) and the justice system enquires into the existence of that illegality.
And if there is a defence for that particular act, the way it was done in that case, codified in the law, that means it's not against the law, and hence not illegal or an offence against the law.
If, in what I assume relates to BP's example, I hit someone as a result of an involuntary spasm, whatever one might personally call it, it wouldn't legally be an assault.
But if one removed the 'spasm' defence, it would have the effect of making spasm-hitting illegal.
