oh and does this set a precedant?

Can you get a woman all hot and bothered online get her to admit she has had a fantasy about rape and then you have case law to get you out of it?

yikes, i dont like where this could go.

  • Up Front: All Together Now,

It is hard to imgaine anything the woman may have written online that would mean she couldn't withdraw consent latter.

She could have written 'I want to vist you and have sex with your friends'

if she latter changes her mind then the whole thing should stop.

The problem is an evidentary one where the facts are disputed. That should have been put to a jury.

  • Up Front: All Together Now,

Thanks for your reply emma. In fact Deb does talk about this more in the comments...

Ideas around this get very complicated when the law is involved.

Your idea around not being able to say no if you can't freely say yes is a good one I think.

its like second wave femanists being annyoyed at 3rd wave feminsts becaue having won thier freedom they choose to wear short skirts.

If people have free choice you have to live with the choices they make even if they bloody piss you off.

    @emma and Renegade Evolution

I can see the point of view that if I feel violated no matter what a court or anyone else says I have the right to that view and no one can tell me otherwise

some concerned comments over there echo my view that it is a very big step to make that because you hold that view everyone else is required to hold it to with out further evidance.

There are people who for various reasons lie about being raped. Are we to send innocent people down to ensure we get all the guilty ones?

  • Legal Beagle: David Garrett wins,

thats the problem with 3 strikes, no one cares what happens on the first two even though they have massive implications on the third. what happens if you are inside for life on your third strike and one of the first two strikes are over turned?

    do you get re-sentenced?

  • Hard News: New Lounge Toy Update,

I have had a TiVo in my living room for the past few months. I also have MySky. We had an aerial issue with sky and couldn't use it for a week. Now that it has been fixed we are finding that we are not using it much at all.

The Tivo interface is nicer to use and most of the content we want to watch is on free to air TV.

I think the black boxes days are numbered, That will save me quite a bit of money!

  • Hard News: Undie Wankers,

I agree there were plenty of morons out and about that weekend.

We have been reminded that just because you get into Uni dosen't make you a responsible young adult..that takes more time.

It seems a large number of young people were spoiling for a fight with police and thats just what they got...I just wonder if there was a better way of avoiding that.
