  • Speaker: ACTA: Don't sell us down the river,

When it comes to the copyright issue, it does become very hard to believe that there's no undue influence being exercised. Why do I say that? Because a majority of voting members of the public who submitted on the disconnection issue were agin the concept, but it still made it into law on the basis of the representations of a handful of mouthpiece bodies. That's not democracy, that's cash-ocracy.

Sounds like normal political process. Majority of submitters doesn't mean much, and nor should it.

Incidentally, Hadyn, there is a sporting connection with Gschwendtner. He plays ice-hockey and once represented New Zealand in an international test-match (if that's the term in ice-hockey) against Slovenia.

I think Michael is pulling your leg there David. We've never played Slovenia in a test.

When a vocal segment of an indigenous people is calling for repatriation of all other peoples, it actually matters a whole lot as to what my origin is. Oh, sure, I know it's never going to happen, but that doesn't mean I don't care.

But the response to that claim shouldn't be "we're all tangata whenua" or similar lines. It should be "we're [non-Maori] all here by rights guaranteed under the treaty and subsequent laws". Absolutely nothing wrong with that claim, 1 generation or six. One silly response doesn't require another one.

That then flows on naturally to "if I have rights which flow from the treaty, what happened to the rights of tangata whenua under that treaty?"

It would also lead to a much better place in terms of modern immigration. "Xth generation NZer" is used by some people to basically be racist about recent immigrants. The treaty wasn't an agreement between Maori and white people, it was an agreement between Maori and the Crown, which now includes people of many different ethnicities.

This country has no true native peoples, just varying degrees of remove from trans-oceanic immigrants.

You can redefine the term until it's useless. Go back to Gondwanaland and very little that we consider native in NZ was here. Native in reality means "was here when white people arrived". We're all actually from Africa and the Middle East, anything after that is a coloniser in one way or the other.

NZ has an indigenous people, who (largely) signed a treaty with the Crown which allowed New Zealand to become what it is today. The attempts of people to move on from that basic fact now that chickens have come home to roost is really shameful.

  • Busytown: A good read,

Take the case of Sherrie Levine's After Walker Evans for example. She rephotographed Walker Evans photos and presented them unaltered. There is a clear attribution in the title of the work, and yet the Estate of Walker Evans successfully prevented the work being sold because of copyright infringement (ie, passing someone else's work off as your own).

Wholesale reproduction of a work or works in their entirety is completely different from Witi's crime. Doesn't matter how much you reference something, you can't just reproduce it entirely.

but anyone who cares about it (Ihimaera's employers for instance?) might be well advised to make a systematic search, rather than simply assuming that they already had a complete accounting of the "borrowings"

You'd like to think that the publisher has been presented with every note and reference and scrap of paper, and a new editor has sat down with Witi and gone through the entire book page by page to create a complete record. He would have the best idea after all.

Witi has already been damaged by this quite a lot. Penguin can probably get out with a minor flaming if they do good work over the next couple of weeks.

It was his intellectual choice of what property to steal, and that is uniquely Witi.

That didn't sound silly while you were typing it?

Calling someone an "arsehole" because they linked to your blog post is beyond ridiculous.

I'm always surprised when people post something on the internet and then discover they don't have absolute control over it. That would be the internet at work.

This is Hadyn's blog so he can write about what he likes, but I find his constant reporting of this really rather minor and amateur roller darby stuff about as interesting as he would find me writing up my indoor netball team every week or two.

Nice that you felt the need to share, rather than just shrug and move on. That's love that is.
