    Heh - that reminds me of the methods Gordon Strachan uses to deal with stupid questions (you've probably seen them before)

    Just to play the devil's advocate for a moment, I'm a bit more worried about the media bitch pack baying for blood after the death of the Kahui Twins.

    Yeah I noticed last week that the Kahui case is approaching the date set down for depositions hearing (which I didn't previously know is a hearing to decide if there is enough evidence for a case to "put a person to trial" according to the MOJ site) and expect another media frenzy.

    Richard Dawkins wrote what I consider quite an interesting essay about the jury system that was republished in his book "A Devil's Chaplain". Whether you generally agree or disagree with Dawkin's, I'd suggest that they are worth a read.

    Maybe the question is whether the general audience has been taught, via years of McDonalds for the brain, that meaningful participation in media and politics is not an option, so why bother.

    Actually given Alan's response, maybe the best question would be: "David, why did you do it?"

    Hadyn, I know this is terribly po-faced but you do recall Bain might well be facing another trial? He's on bail, not acquitted. And if he does it's going to be hard enough to impanel a reasonably unbiased jury without some clever dick hack pulling the 'have you stopped beating your wife" interview technique.

    well with respect Damian, because what i've seen of your work i think is very good, that's a pretty standard industry defence. but for one thing it conveniently ignores the fact that viewing trends and tastes take a while to develop and build. the rare examples of long-format high-brow programming we see these days are invariably one-offs (therefore never getting a chance to build), and perhaps because of the lack of opportunities to practice, often not that well executed (thus audiences change channels to more familiar fare).

    there is no evidence to say today's audiences would consistently shun long format high-brow interviews because when was the last time they had a chance to rekindle a taste for them? the closest thing to it is Agenda, which while being a great program, is safely tucked away in ghetto slots to make sure audiences don't develop too much of a taste for a show that requires dollars and talent to make.

    obviously there is some level of misrepresentation in some self-reporting about consumption habits and preferences (surveyors call them "demand characteristics"), but i think they are often over-played as a defence.

    By the way (sorry for interrupting), I did wonder how long it would take for the David Tamihere case to raise its head, given the Bain decision.

    It has this afternoon, but due to the lack of a Joe Karam, can't see the poor bastard will ever be released.

    (In case you've forgotten, Tamihere is in prison for the Swedish Tourist murders; the evidence in this trial was even more dodgy than the Bain case)

    The next one will be Scott Watson.

    Society has become grey. The legal system is black and white.

    How can the two be reconciled? Who has new ideas on this?

    Tamihere is in prison for the Swedish Tourist murders; the evidence in this trial was even more dodgy than the Bain case

    I imagine that one of the Solicitor General's arguments for a retrial would be to pre-empt Tamihere, Scott et al from getting to the same point.

    I can also imagine Father and Son being in it together. I haven't heard that theory put forward.

    I suppose this also explains why his lawyer and PI are so keen to discredit the entire Dunedin police establishment, including it would seem, those that are dead.

    I'm totally turned off by all things Bain-related right now. If he's innocent, leave the poor guy alone. If not, he's getting undeserved fawning. Either way I don't want to know.

    Apropos the long-format interview show: I would have to start a television habit again. I rarely watch television at all these days, and I actively avoid the so-called news (the "journalists" vapid mugging and the emotional porn content cause me to shout at the screen in a deranged manner). Thus my delicate mind has been happily undisturbed by the TV coverage of the Bain case. I simply couldn't give a toss what TV has to show.

    Since this is the internet, I'm going to generalise wildly from my own feelings: I suspect that whatever potential audience there is for high-brow current affairs has probably abandoned TV altogether in favour of other media.

    damian, one michael laws is 9 too many - know you mean well though sport . bit slow to post me, but been in Court all day, defending . Did follow this case , read the books followed the appeals . First Trial lawyer - marginal at best. 2003 Court Of Appeal decn - lazy , weak , piss poor. Guilty Beyond Reasonable Doubt ?- not by a Te Kauwhata mile , honest, watch that space .

    And to the guy on the ipod guess ...'heaven knows I'm miserable now ' after a week with Karam - that really made me giggle .

    Well, I like to be a contradiction me, which is why I shall continue to read North and South, and watch Survivor; listen to Solid Gold, and enjoy Hotere's art; play Foreigner really loudly, and listen to Bach whilst I work. And so on. I cannot be bothered with all this highbrow wankery. And isn't it great that we are all different. Far more interesting than everyone reading the NBR and reading books in the evening with a glass of good red wine. Back to the topic, though. Although I neither know nor care whether Bain is innocent, the only people it need concern are his family, and himself, surely? The media scrum was alarming, the questions inane, and as for what's on his ipod one would have to imagine that if he did murder his family it would be 10CC's " The things we do for love....." and if he's innocent, wouldn't it have to be something from Al Stewart, like " Time Passages" or Bill Withers' "Steppin' Right Along"?
