  • Matthew Poole, in reply to Sofie Bribiesca,

Those rules for still photographs also look like the shot of Amanda Banks in the witness box yesterday would also be in breach of the rules.

How so? I cannot find the photo to look at it, but I see nothing in the rules prohibiting the photographing of witnesses provided the court is in open session.

  • Alfie,

I've edited court footage from a number of high profile trials and being able to use only the "first 15 minutes" of the day seems unnecessarily restrictive and outside the usual rules imposed on court coverage. It would be impossible to cover the day's proceedings accurately and this "rule" is certainly not the norm. But of course it's entirely up to each individual judge to interpret the rules as he/she sees fit - even inventing rules like this which are are just plain silly.

The TV3 editor was supplied with pool footage shot by another broadcaster. When you're up against a deadline and looking for cutaways of Banks watching proceedings, it would be easy to grab a shot like this without paying regard to the time of day it was recorded. If I was cutting the story would I have used a shot of Banks chewing his earwax? You bet I would have - but that's probably my personal feelings about the man coming to the fore. When you're claiming the moral high ground, it's best not to consume your own bodily excretions in front of TV cameras.

As an aside, today's Herald has an excellent cartoon on the subject of Banks' ear wax.

It certainly has disappeared from the herald. It certainly was during her testimony and well after the first 15 mins. Anyway I'm not getting up in your face about it. So be it. Judge decides.

Not sure that that rule applied to still photography, though. It's not a rule in the general guidelines.
