    The Supreme Court has just released a judgement on one of the appeals in Bain. Plenty to read there and no doubt TV will be full of it.

    Short version from Philip's link:

    The 111 call was made by the appellant when he reported the deaths of his family members. On 30 January, the Court of Appeal dismissed the appellant’s appeal against the ruling as to admissibility. 3 Mr Bain has been granted leave to appeal further to this Court on the admissibility of part of the recording. The part of the recording to which objection is taken contains what the Crown says is an admission: “I shot the prick” or “I shot that prick”.

    But as he says, there's quite a lot else to read there.

    Any truth to the rumour (reported on TV1 Breakfast) that the sign-written vote-for me car of the "not a bitch from hell" was in a handi-capped parking spot outside the tavern...

    Is that a sad reflection of entitlement or a nasty smear from opponents? I guess we should we assume "pictures or it didnt happen"?

    We (luckily) made it to The Neighbourhood bar early -8ish? & it was already packed. Got a spot by the bar next to the blogger from The Standard. Loads of fun, although the catcalls, cheers & boos made a lot of the responses hard to hear.
    Will watch the link now to see what I missed!

    You're not listening hard enough. Just towards the end you can also hear where he hid Hoffa's body.

    It might be a problem if the Police actually took enforcement of the Electoral Act with any degree of seriousness.

    s217(2) says more or less (v. complex construction)

    Every person commits the offence of treating who corruptly (gives). . . any food, drink, entertainment, or provision . . .
    (b) for the purpose of procuring himself or herself to be elected;

    So there would be a number of things to be proven and any investigation would like as not end up in the too hard basket.

    I understand that there have been virtually no complaints of alleged treating in the last three general elections.

    Juries, of course, are too stupid to understand this sort of thing, so the court makes sure they do not hear it and become hopelessly confused.

    I changed the post upon releasing that the part in question was excised from what the jury heard.

    Which seems a little like tampering with evidence to me ...

    I suspect that the phone call is evidence that there was another person in the room while David was on the phone.

    This second person is the actual killer.

    No one, said the security guys, was going in unless someone came out. And at 9pm, no one was coming out.

    Ha, I had one trying to remove me because obviously the joint must have been mine. Then Damian says "you missed out on your question" to which I could only offer "But I had to go wee". Still my dog got in later(it had cleared out by then) which is what I like about the neighbourood bar.

    I think the offence of "treating" was orginally applied to Tammany Hall type practices such as setting up outside the polling booth with a barrel of beer.

    A free cup of tea at a candidate meeting doesn't really amount to that.

    While I think it is usually a good idea for a jury to decide upon the relevance of various pieces of evidence. If they get exposed to interpretations, pareidolia can be extremely convincing.

    You can't ask a jury to hear things without preconceptions. That part of the brain is hardwired.
